Borenius advised Matkahuolto, the Finnish Bus and Coach Association and Väinö Paunu on a landmark antitrust dispute
We represented Matkahuolto, the Finnish Bus and Coach Association and Väinö Paunu Oy on a bus cartel case before the Finnish Competition Authority (FCCA), the Market Court and the Supreme Administrative Court (SAC).
The FCCA had originally proposed that fines of over EUR 38 million be imposed on seven bus companies, the Finnish Bus and Coach Association and Matkahuolto for anticompetitive behaviour. However, as the court of last instance, the SAC imposed significantly lower fines in August 2019. The total amount of fines for all parties was less than EUR 9 million.
Furthermore, when compared to the FCCA’s proposal, the SAC also significantly reduced both the scope and duration of the alleged antitrust infringement.
